Court Voids Neenah Short-Term Rental Restriction

The Court of Appeals voided a City of Neenah, Wisconsin, ordinance restricting short-term rentals to properties that are the owner’s primary residence. The court sided with the Wisconsin Realtors Association (WRA), which appealed a circuit court’s decision granting summary judgment in favor of Neenah and its Tourist Housing Ordinance. Under the ordinance, short-term rentals must be the owner’s primary residence. The WRA argued the rule conflicted with state law.
