Arkansas Judge Dismisses Lawsuit Against City over STR Ordinance

A judge in Fayetteville, Arkansas, has dismissed a lawsuit challenging the city’s short-term rental (STR) ordinance, siding with local officials. Doug Martin of the Washington County Circuit Court granted summary judgment in favor of the city, citing a prior federal ruling that upheld the ordinance’s constitutionality. The lawsuit was filed by homeowners who argued the rules were vague and amounted to an unlawful taking after their application for an STR permit was denied because of neighborhood limits. However, the court also found the plaintiffs failed to appeal the planning decision in time.
