Atlanta City Council Clears Way for STR Enforcement

The Atlanta City Council narrowly approved an amendment to its 2021 short-term rental ordinance, clearing the way for enforcement beginning in January. The change removes a requirement limiting hosts to their primary residence plus one additional property, allowing the city’s Planning Department to enforce existing rules on licensing, noise, occupancy, property conditions, and nuisances. Supporters said enforcement has been hindered by legal concerns surrounding residency requirements and argued that regulations are ineffective without enforcement. Opponents warned the change could encourage more absentee investors, reduce affordable housing, and increase neighborhood problems. A proposal to cap hosts at two STR units was rejected. The council has previously taken piecemeal action, including banning STRs in Home Park, while rejecting a proposed north Buckhead ban. Some officials said broader restrictions are still needed.
