Bid to Nullify Nantucket's Vote Legalizing STRs Submitted to Attorney General

12/22/2025

A legal challenge has emerged seeking to nullify Nantucket’s recent vote to legalize short-term rentals by right across most zoning districts. Attorney Nina Pickering-Cook submitted a request to the Massachusetts Attorney General urging rejection of the zoning amendment, arguing it violates a state law barring reconsideration of previously defeated zoning bylaws within two years. Although voters approved the measure with a strong majority in November, she contends similar proposals failed at multiple earlier town meetings. Town officials and the article’s sponsor maintain the bylaw is legally distinct and valid, citing prior legal review. The Attorney General must now decide whether to approve or reject the amendment before it takes effect.
