Breckenridge STR Fee Lawsuit Reaches Colorado Supreme Court
11/3/2026
The Colorado Supreme Court will review Breckenridge’s annual $756-per-bedroom short-term rental regulatory fee after two lower courts rejected a property owner’s lawsuit alleging it violates the state’s Taxpayer’s Bill of Rights. Owner and attorney Alexander Dorotik argues the fee is an unconstitutional tax because STRs already generate sales and lodging tax revenue. Breckenridge introduced the fee in 2021 to address workforce housing pressures associated with visitor spending. Revenue funds deed-restricted housing, property buy-downs, and programs encouraging rentals to local workers. The state Supreme Court will examine whether existing tax revenue undermines the justification for additional regulatory fees.

The court’s review could influence how Colorado communities structure STR fees and distinguish regulatory charges from taxes requiring voter approval. Managers should monitor the case while continuing to account for the existing fee in their operating budgets.
