Court Order Barring STR Crackdowns in Clark County, NV, Must Be Narrowed, Appeals Court Says

10/12/2026

The Ninth Circuit Court of Appeals has ordered a federal court to narrow an injunction restricting Clark County, Nevada, from enforcing illegal short-term rental regulations. The injunction, issued in December, paused fines and citations after homeowners and Airbnb challenged the county’s rules as unconstitutional. Clark County appealed the decision, seeking to restore enforcement. The appeals court’s ruling sends the case back to the District Court for revisions. Narrowing the injunction could allow the county to reopen its short-term rental licensing application portal, with applicants potentially protected from certain penalties while their applications are reviewed.
