Edinburgh Landlords Win Third Legal Battle Over Short-Term Let Suspensions

A third legal challenge to the Scottish City of Edinburgh Council's short-term letting licensing process was overturned by a recent court ruling. Over 450 landlords had been suspended from operating for three months after applying for letting licenses without securing the required planning permission. The judge ruled that the council had applied a "blanket and arbitrary approach without giving proper consideration to the particular circumstances of each application." The council has reversed the suspensions and agreed to issue licenses to applicants that completed the appropriate forms and have no other outstanding issues. The council stated, "This [decision] should in no way be taken as an indication of acceptance that planning permission is not required in relation to any application." The short-term letting licensing scheme is under consultation on its effectiveness, a review that will end on Oct. 14.
