Fayetteville City Council to Consider Amendments to Short-Term Rental Ordinance

In Arkansas, the Fayetteville City Council is considering officially adopting a short-term rental ordinance with several amendments this week. The ordinance separates residential property rented for fewer than 30 days into two categories. Type 1 requires an owner or occupant to occupy the residence for at least nine months out of each year. There is no cap on the number of Type 1 short-term rentals permitted in the city. Type 2, meanwhile, does not require a permanent resident and allows for the residence to be used as a full-time short-term rental. Only 475 Type 2 rentals are currently allowed citywide. The city defines a short-term rental as a residence being leased out for fewer than 30 days. There are three main categories for the proposed amendments. The first is occupancy, while the second is enforcement, and the third is frequency and concentration. With regards to enforcement, for example, the proposed amendment would allow for utilities service (water, sewer, solid waste) to be shut off for one month after the first violation of non-compliance and extended to six months for multiple violations. Another amendment would prohibit a Type 2 rental being within 100 feet of another Type 2 rental.
