Indiana’s Rental Cap Ban Is Now Law

What is it? 

HEA 1210 bars local governments from limiting the number of residential rental properties—a prohibition that reaches STR license caps. Carmel and Fishers, the two cities with existing caps, have until January 2028 to wind theirs down. Registration requirements survive, and both cities have signaled they'll keep their registries. 

Why does it impact me? 

Caps hurt professional managers most because they freeze portfolio growth and make permits effectively non-transferable. Indiana members should confirm every property is registered—the wind-down covers the cap, not the registry—and watch HOAs, where restriction fights may migrate next. The near-unanimous vote is also a fresh proof point for members pushing similar bills in other statehouses.
