NY State Supreme Court Deems Hague's STR Law Invalid

The New York State Supreme Court has invalidated the Town of Hague’s Short Term Rental (STR) Law, Local Law #1 of 2024, after nine months in effect. The law had restricted new property owners from obtaining STR permits for three years and imposed minimum rental durations, aiming to address housing shortages and community concerns. Mato Properties, LLC challenged the law, arguing among other points that the town failed to comply with the State Environmental Quality Review Act (SEQRA). Judge Robert Muller ruled that SEQRA review was required due to potential environmental impacts, including noise, garbage, and septic system use. The court’s decision overturns the law, and the town will refund STR permit fees. Plaintiffs and STR owners welcomed the ruling, highlighting the need for collaboration with the town to develop sustainable policies while respecting existing zoning laws and the rights of property owners.
