South Lake Tahoe Won't Appeal After Court Overturns STR Restrictions

Officials in South Lake Tahoe, California, will not challenge a recent El Dorado County Superior Court ruling that struck down Measure T, a voter-approved law that banned most short-term and vacation home rentals in residential neighborhoods. The City Council voted against appealing the decision in early April. Since Measure T took effect, short-term rentals were only allowed in tourist and commercial zones, with limited exceptions for full-time residents. The court ruled that Measure T’s “permanent resident” exception — which allowed homeowners who lived at their property most of the year to rent it short term for up to 30 days — violated the dormant Commerce Clause of the U.S. Constitution. The judge found that the provision, passed by voters in 2018, discriminated against out-of-state property owners and was too central to the law to be separated from it.
