Supreme Court Says Burlington Can Regulate Short-Term Rentals

Vermont's highest court has ruled that the City of Burlington can legally regulate short-term rental properties. Property owners had sued over the city's rental ordinance nearly two years ago. Still unanswered, however, is whether the plaintiffs' units — which were available for rent before the ordinance went into effect, are subject to the rules. Passed in 2022, the city ordinance defines short-term rentals as units that are leased for more than 14 days and fewer than 30 consecutive days in a 12-month period. Hosts who list such properties must live on the same lot or in the same building as the unit, with few exceptions.
